When a person lacks the ability to make decisions on their own behalf due to some sort of illness, disability or accident, a guardian or conservator steps into make those decisions for them. The Virginia Court appoints this person to be the legal decision maker for the person lacking that capacity, and grants them medical and/or financial power of attorney.

There are several ways a person can end up with a guardian or conservator:

  • Dementia or cognitive decline: Incapacity from conditions such as vascular dementia or Alzheimer’s is a common reason for guardianship proceedings to begin.
  • Accident or injury: You could suffer an accident (such as a traumatic brain injury) that leaves you incapacitated or incapable of making your own decisions.
  • Birth conditions: Conditions like Down’s syndrome or autism may result in the need for a guardian or conservator.
  • Mental illness: Mental illnesses such as schizophrenia or psychosis can also lead to the appointment of a guardian or conservator.
