Wills Attorney in Fairfax, Virginia

A properly drafted will is one of the most important parts of any estate plan. It allows you to clearly state how your assets should be distributed, who will manage your estate, and who will care for your minor children if something happens to you.

At Speedwell Law, we help individuals and families in Fairfax, Merrifield, and across Northern Virginia create clear, legally sound wills that reflect their wishes and protect the people they care about most.

Whether you are creating your first will or updating an existing one, having a properly prepared document can help prevent confusion, reduce family conflict, and ensure your intentions are carried out.

Why Having a Will Matters in Virginia

Many people delay creating a will because they think it is unnecessary or something they can do later. However, without a valid will, Virginia law decides how your assets are distributed.

This can lead to outcomes that do not reflect your wishes and may create unnecessary stress for your loved ones.

In Fairfax and surrounding communities, a will is commonly used to:

  • Specify who inherits your property
  • Name guardians for minor children
  • Appoint an executor to manage your estate
  • Reduce potential family disputes
  • Provide clear instructions for asset distribution
  • Support a broader estate plan (including trusts if needed)

A well-prepared will gives you control and clarity over important decisions.

What Is a Will?

A will is a legal document that outlines how your assets and responsibilities should be handled after your death.

It typically includes instructions for:

  • Distribution of property and assets
  • Appointment of an executor (personal representative)
  • Guardianship of minor children
  • Specific gifts or bequests
  • Final wishes and instructions

A will only takes effect after death and must go through probate in Virginia. However, it remains a foundational document in most estate plans, even for individuals who also use trusts.

At Speedwell Law, we ensure your will is drafted clearly and coordinated with the rest of your estate planning documents so everything works together properly.

Benefits of Having a Will

A properly drafted will provides important legal and practical benefits for families in Virginia.

Clear Distribution of Assets

A will allows you to clearly state who receives your property, helping avoid confusion or disputes among family members.

Guardianship for Minor Children

If you have minor children, a will allows you to designate who should care for them if something happens to you. Without a will, the court makes this decision.

Appointment of an Executor

A will lets you choose a trusted person to manage your estate, handle paperwork, and carry out your instructions.

Reduced Family Conflict

Clear written instructions can help reduce misunderstandings and disagreements during an already difficult time.

Foundation of an Estate Plan

Even if you have a trust, a will is still often used as a backup document (commonly called a “pour-over will”) to ensure any remaining assets are properly handled.

Who Should Have a Will?

Almost every adult should have a will, regardless of income or asset level.

A will may be especially important if you:

  • Have children or dependents
  • Own real estate or other valuable assets
  • Are married or in a blended family
  • Want to name guardians for children
  • Want to decide how your assets are distributed
  • Want to avoid uncertainty for your family

Even a simple estate can become complicated without clear legal instructions.

Wills vs. Other Estate Planning Tools

Many people confuse wills with other estate planning tools, but they serve different purposes.

A will:

  • Takes effect after death
  • Must go through probate
  • Controls assets in your name alone

A living trust:

  • May avoid probate
  • Can manage assets during incapacity
  • Often works alongside a will

Most complete estate plans use both tools together.

At Speedwell Law, we help clients determine whether a will alone is sufficient or whether additional planning tools are needed.
